Arbitration, the class-action waiver, and how to opt out
Disputes go to informal resolution for 60 days, then binding individual arbitration under AAA rules. You can opt out within 30 days of accepting the terms by emailing legal@slopsquash.com.

Section 20 of the terms governs disputes. In plain words:
Talk first
Before any proceeding, the party raising a dispute sends the other a written notice describing it and the relief sought. Notices to us go to legal@slopsquash.com with "Notice of Dispute" in the subject and your name and account email. Both sides then try in good faith for 60 days.
Then arbitration
Disputes not resolved informally go to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (Commercial Rules for business use), before a single arbitrator, by video unless an in-person hearing is needed. For non-frivolous claims under $10,000 we pay the AAA filing, administrative and arbitrator fees, and we do not seek our attorneys' fees in a consumer arbitration unless the claim is frivolous.
Exceptions
Either side may bring an individual claim in small-claims court, seek injunctive relief in court to protect intellectual property or stop abuse of the service, or bring a claim the law does not allow to be arbitrated.
No class actions, no jury
Claims are individual only; no class, collective or representative proceedings, and both sides waive a jury trial. If 25 or more similar demands are filed by coordinated counsel, a batching process applies.
Opting out
Within 30 days after you first accept the terms (or, if you accepted before the effective date, within 30 days after it), email legal@slopsquash.com with the subject "Arbitration opt-out", your name, the email on your account, and a statement that you wish to opt out. The rest of the terms are unaffected; disputes then go to the New York courts and the class-action waiver does not apply.
Changes to this section
If we materially change it, you may reject the change by emailing legal@slopsquash.com within 30 days after it takes effect, and the version you last agreed to continues to apply.
Creators
The same section applies to creator program disputes, with a liability cap of $50 or the commissions paid to you in the prior 12 months, whichever is greater.
